Rep. Henry Cuellar (D-Texas) is criticizing Joe Biden’s border strategy, which is based on the honor system. Biden’s open-border agenda affects border districts like Cuellar’s, and he’s been battling him for it since the inauguration.
The border has become a major problem, not to mention the untested, illegal aliens who have tested positive for COVID-19 who are being sent into the country’s interior. This exacerbates the pandemic.
Cuellar, who serves Texas’ 28th congressional district, takes the border issue very seriously. His congressional district stretches the length of the US-Mexico border. It also contains the third busiest crossing into the United States, the Laredo, Texas border crossing.
Since Biden took office three months ago, more than 15,300 migrants have been released from detention without formal notices to appear in immigration court, according to Cuellar.
Even more surprising, Cuellar told Border Report that the number was just 2,000 at the end of March.
Cuellar said, “Basically it’s just an honor system. It’s just an honor system that they are given and this is not the way it’s supposed to be.”

In an effort to process, sort and separate [migrants] during this coronavirus pandemic and determine who will be moved to other facilities, federal officials are releasing thousands of migrants much quicker than normal and giving them what is known as a 385 form or booking report.
Unaccompanied migrant children are not fast-tracked. Instead, they are all taken into the care and custody of the U.S. Department of Health and Human Services’ Office of Refugee Resettlement. But the number of unaccompanied youth is unprecedented, especially those crossing into South Texas, and they are taking up much of the space in DHS facilities used to process the migrants. And this has triggered thousands of migrants to be fast-tracked in the field, border experts tell Border Report.
Migrants who are released from government detention are usually given a Notice to Appear, which is a document that tells them when they must appear in front of an immigration judge. The 385 form, according to Cuellar, simply instructs migrants to report to an Immigration and Customs Enforcement office within a certain number of days.
The issue, according to Cuellar, is that many migrants who are being fast-tracked for release are unaware of when or where they may report to a judge.
Cuellar said, “They’re not put into the immigration system where they’re supposed to go before a judge,” “It will be interesting to see how many of those (issued) 385s are going to show up [for court].”
Cuellar has criticized Biden’s immigration proposals, which have so far consisted of reversing former President Donald Trump’s deterrent policies.
In late February, Cuellar said:
‘You just can’t say, ‘Yeah, yeah, let everybody in’ — because then we’re affected down there at the border,” “The bad guys know how to market this.
Cuellar said in a separate interview, “We are weeks, maybe even days, away from a crisis on the southern border. Inaction is simply not an option. Our country is currently unprepared to handle a surge in migrants in the middle of the pandemic.”
