Feds’ claim: a 2020 ballot
HSI Atlanta “confirmed” in August 2026 that Higgs had illegally voted in the 2020 election, the Caller reports. The Caller also reports that Higgs was admitted to the United States as a lawful permanent resident in October 1976 and that the Department of Homeland Security has placed him in removal proceedings to rescind his LPR status due to his crimes.
Criminal convictions listed in records
The Daily Caller, citing records, lists Higgs’ criminal history as including convictions for two counts of grand larceny, armed robbery with a deadly weapon, two counts of possession of a weapon during a violent crime, assault on a police officer, criminal domestic violence, and resisting arrest.
Quoted statement
In a message to the Daily Caller, Markwayne Mullin—identified in the Caller’s reporting as DHS Secretary—was quoted describing Higgs as having “a rap sheet for multiple violent crimes, including armed robbery, domestic violence, and assault on a police officer,” adding, “On top of all of that, he illegally voted in the 2020 election.” Mullin is quoted as saying removal would prevent interference “in our elections again.”
Separate Sept. 1 arrest tied to 2024 voting
Two days earlier, on Sept. 1, ICE and HSI officers arrested Mariana Alexandra Dewey, a Peruvian national, for allegedly misrepresenting herself as a U.S. citizen while voting in the 2024 general election in Kansas, the Daily Caller reported exclusively. According to the Caller, Dewey was charged with one count of false claim of citizenship, one count of false claim of U.S. citizenship in order to vote, one count of fraudulent election conduct, and one count of voting by an alien in a federal election.
Source: recent DHS actions on election security
The Caller reports that in recent months DHS has taken steps related to election security and eligibility, including July letters to multiple secretaries of state regarding noncitizen registrations, new FEMA grant requirements tied to election security announced in July, and a June DHS directive for ICE to enforce stricter penalties for noncitizens who illegally vote, including deportation.
