The 5th U.S. Circuit Court of Appeals based in New Orleans, Louisiana, handed President Donald Trump a huge victory on Wednesday. In a 2-1 decision, the panel gave the president the green light to spend $3.6 billion in military construction funds on the long awaited border security wall.

Liberals are in tears. “A court has already determined that the government can’t lawfully use military construction funds to build Trump’s border wall,” whines Kristy Parker from advocacy group Protect Democracy. “It’s unfortunate that the people of El Paso will continue to suffer harm.”

President Trump couldn’t wait to get on Twitter. “Entire Wall is under construction or getting ready to start!”

White House press secretary Stephanie Grisham issued a statement on Thursday that the court had lifted an ‘illegitimate nationwide injunction’ and in doing so had allowed work on the border wall to continue with military construction money. We will finish the wall.”

According to the court’s decision, the open border advocates who filed the challenge didn’t have a legal leg to stand on.

The judges ruled there was a “substantial likelihood” that the county of El Paso, Texas, and the Border Network for Human Rights” lacked standing to sue the Trump administration.”

Not only that, the U.S. Supreme Court already sided with the Trump administration in a similar case in the 9th U.S. Circuit Court of Appeals.

The $3.6 billion is just over a third of the approximately $10 billion that President Trump secured for wall construction. The rest was appropriated by congress and redirected from Defense Department and Treasury Department accounts.

In February of 2019, President Trump declared that illegal immigration is a national emergency. “We don’t control our own border,” Trump exclaimed. “We’re going to confront the national security crisis on our southern border… one way or the other we have to do it.”

So far, 96 miles of existing barriers have been replaced and construction has already started in areas which were previously wide open.
